This Privacy Policy describes how Plurality Web Products LLC d.b.a. Shoplift (together with its affiliated companies - “Shoplift”, “we”, “us” and/or “our”) collect, use, disclose, and otherwise process user data in connection with our Services, including the use of the Shoplift web application.

Please review this Privacy Policy carefully, and please use the information herein to make informed choices. If you have any concerns or questions about our privacy practices, please feel free to contact us. By accessing the sites, registering for an account, or making a purchase from us, you are agreeing to all of the terms set forth in this Privacy Policy.

If you do not agree to this Privacy Notice, do not use the sites, purchase our products, interact with us, or give us any information.

Our Services are designed for businesses and are not intended for personal or household use. Accordingly, we treat all personal data covered by this Privacy Notice, including information about any visitors to our sites, as pertaining to individuals acting as business representatives, rather than in their personal capacity.

You are not legally required to provide us with any personal data. If you do not wish to provide us with your personal data, or to have it processed by us or any of our service providers, please do not provide it to us and avoid any interaction with us or with any of our Services.

Personal Information

The term “Personal Information” in this Privacy Policy refers to information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to an individual. It does not include aggregated or anonymized information that is maintained in a form that is not reasonably capable of being associated with or linked to an individual.

We collect the following categories of personal data, with respect to the following types of data subjects:

 User Data: Personal data concerning our customers’ internal focal persons who directly engage with Shoplift concerning their organizational account, and users of the platform on behalf of such customers, as well as the customer’s business needs and preferences, as identified to us or recognized through our engagement with them.

●  Prospect Data: personal data relating to visitors of our websites, participants at our events, and any other prospective customer, user or partner (collectively, “prospects”) who visits, purchases, or otherwise interacts with our sites and Services.


Specifically, we collect or generate the following types of personal data about such individuals through the Services:

Usage and device information concerning customers, users and prospects (connectivity, technical and aggregated usage data, such as user agent, IP addresses and approximate location based upon such IP addresses (geolocation), device data (like type, OS, device id, browser version, locale and language settings used), activity logs, session recordings, website chat feature data, log-in credentials to the Services, the cookies and pixels installed or utilized on their device, and inferred or presumed data generated from their use of the Services, other internet or  electronic network activity information and other device or browser information);

●  Information concerning our customers, users and prospects (contact and business details such as name, email, phone number, position, workplace and professional information, and related business insights, our communications with such individuals (and any analyses thereof), feedback and testimonials received, as well as any expressed, presumed or identified needs, preferences, attributes and insights relevant to our potential or existing engagement), purchasing details including interest and/or purchase history, commercial information, including records of our products or services purchased, obtained, or considered)


For the purposes of the California Consumer Privacy Act ("CCPA"), in the last 12 months, we have collected the following categories of personal information, as defined in the CCPA: Identifiers; Customer Record Information; Internet or other electronic network activity information; Professional or employment-related information; Geolocation Data; Commercial Information; Inferences; and Audio, electronic, visual, thermal, olfactory information.

We have collected such personal information from the following sources:

• Automatically, when you visit the Site

• Merchants and Users

• Service Providers

How We Use Personal Information

Shoplift uses Personal Information to:

●  Fulfill or meet the reason for which the Personal Information was provided.  For instance, if you contact us by email, we will use the Personal Information you provide to answer your question or resolve your problem.  

●  Communicate with individuals, including via email, text message, push notification, social media and/or telephone calls;

●  Provide you with access to the requested product or services and to monitor your use of such product or services;

●  Operate, maintain and provide the features and functionality of the Services;

●  Help us improve the content and functionality of the Services, to better understand our users and to improve the Services;

●  Market to individuals or contact individuals in the future to tell them about services we believe will be of interest to them.  If we do so, each marketing communication we send you will contain instructions permitting you to “opt-out” of receiving future marketing communications.  In addition, if at any time you wish not to receive any future marketing communications or you wish to have your name deleted from our mailing lists, please contact us as indicated below;

●  Personalize experiences and deliver custom content and product and service offerings relevant to an individual’s interests, including targeted offers and ads through our websites, third-party sites or on other devices an individual may use;

●  Recognize an individual and remember their information when they return to our Services;

●  Help maintain the safety, security and integrity of our property and Services, technology assets and business;

●  Improve, test, enhance, update and monitor the Services or to diagnose or fix technology problems;

●  Ensure the security of our or another’s premises, property or other assets;

●  Defend, protect or enforce our rights or applicable terms of use;

●  Prevent fraud or the recurrence of fraud;

●  Comply with or as otherwise permitted by law.

Retention of Personal Data

We retain personal data for as long as we deem it as reasonably necessary in order to maintain and expand our relationship and provide you with our Services and offerings; in order to comply with our legal and contractual obligations; or to protect ourselves from any potential disputes (i.e., as required by laws applicable to log-keeping, records and bookkeeping, and in order to have proof and evidence concerning our relationship, should any legal issues arise following your discontinuance of use)

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and the applicable legal requirements.

Please note that except as required by applicable law or our specific agreements with you, we will not be obligated to retain your personal data for any particular period, and we are free to securely delete, anonymize or restrict access to it for any reason and at any time, with or without notice to you.

Disclosure of Personal Information

Within Shoplift: Shoplift entities may disclose Personal Information to other Shoplift entities for purposes and uses consistent with this Privacy Policy.

Service Providers:  Shoplift may sometimes employ third parties and service providers to provide services on our behalf to our website visitors, our customers, and users of the product and services. We may need to share your information with service providers to provide information about products or services to you. Examples may include removing repetitive information from prospect lists, analyzing data or performing statistical analysis on your use of the Subscription Service or interactions on our websites, providing marketing assistance, supplementing the information you provide us in order to provide you with better service, developing and improving the product and services, and providing customer service or support. These service providers are prohibited from using your Personal Data except for these purposes, and they are required to maintain the confidentiality of your information. In all cases where we share your information with such agents, we explicitly require the agent to acknowledge and adhere to our privacy and data protection policies and standards.

With Third-Party Widgets: If you click on a widget or social media feature, like the Facebook “like” button, these widgets will share information with the widget provider (like IP address, the which page you are visiting on the Services and may set a cookie to enable the feature to function correctly).

Your Employer:  If you are using the Services in connection with your role as an employee or contractor of a company or other legal entity, we may share your information with such entity.

Legal Requirements:  Shoplift may disclose your Personal Information if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation or with applicable law, court order, or governmental regulation, (ii) protect and defend the rights or property of Shoplift, (iii) act in urgent circumstances to protect the personal safety of users of the Services or the public, or (iv) protect against legal liability.

Third Parties in the Context of a Corporate Transaction:  We may disclose Personal Information as reasonably necessary to evaluate, negotiate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Shoplift assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by Shoplift about consumers is among the assets transferred or is otherwise relevant to the evaluation, negotiation or conduct of the transaction.

Our Services currently do not respond to “Do Not Track” (DNT) signals and operates as described in this Privacy Policy whether or not a DNT signal is received. If we do so in the future, we will describe how we do so in this Privacy Policy.

Cookies and Online Ads
Cookies

What We Collect:

We, and our third-party partners, may automatically collect certain types of usage information when an individual visits our websites or interacts with our Services.  We may collect this information through a variety of data collection technologies, including cookies, web beacons, embedded scripts, location-identifying technologies, file information, and similar technology (collectively, “cookies”).  For example, we may collect information about an individual’s device and its software, such as IP address, browser type, Internet service provider, platform type, device type, operating system, date and time stamp, and other similar information.  We may collect analytics data or use third-party analytics tools such as Google Analytics to help us measure traffic and usage trends for our Services and to understand more about our users.

How We Use That Information:

We use or may use the data collected through cookies to: (a) remember information so that an individual will not have to re-enter it during their visit or the next time they use our Services; (b) provide and monitor the effectiveness of our Services; (c) monitor aggregate metrics such as total number of visitors, traffic, usage on our Services; (d) diagnose or fix technology problems; or (e) otherwise to plan for and enhance our Services.  As explained in more detail below, we and our advertising partners also use this information to understand browsing activities, including across unaffiliated third-party sites, so that we can deliver ads and information about products and Services that may be of interest to an individual.

Choices About Cookies:

To manage cookies, an individual may change their browser settings to: (i) notify them when they receive a cookie, so the individual can choose whether or not to accept it; (ii) disable existing cookies; or (iii) set their browser to automatically reject cookies.  Please note that doing so may negatively impact an individual’s experience using our websites, as some features and Services on our websites may not work properly.  Depending on an individual’s device and operating system, they may not be able to delete or block all cookies.  In addition, if an individual wants to reject cookies across all their browsers and devices, they will need to do so on each browser on each device they actively use.  An individual may also set their email options to prevent the automatic downloading of images that may contain technologies that would allow us to know whether they have accessed our email and performed certain functions with it.

Online Advertising

What We Collect and How We Use It:

We participate in interest-based advertising and use third-party advertising companies to serve targeted advertisements based on an individual’s browsing history.  We permit third-party online advertising networks, social media companies and other third-party services, to collect information about an individual’s use of our online Services over time so that they may play or display ads on other websites, or services an individual may use, and on other devices an individual may use. The collection and use of information by third party cookies may be limited by certain operating systems and/or browsers. Typically, though not always, the information used for interest-based advertising is collected through data collection technologies, such as cookies, embedded scripts, location-identifying technologies, and similar technology (collectively, “data collection technologies”), which recognize the device an individual is using and collect information, including click information, browser type, time and date the individual visited the website, AdID, precise geolocation and other information.  We may share a common account identifier (such as a hashed email address or user ID) with our third-party advertising partners to help identify an individual across devices.  We and our third-party partners use this information to make the advertisements an individual sees online more relevant to their interests, as well as to provide advertising-related services such as reporting, attribution, analytics and market research.

Choices About Online Ads:

We support the self-regulating online interest-based advertisements on their internet browser from advertisers and third parties that participate in the DAA program and perform advertising-related services for us and our partners, regulatory principles for online behavioral advertising (“Principles”) published by the Digital Advertising Alliance (“DAA”).  This means that we allow an individual to exercise choice regarding the collection of information about their online activities over time and across third-party websites for online interest-based advertising purposes.  More information about these Principles can be found at www.aboutads.info. If an individual wants to “opt out” they can follow the instructions.

When electing to opt-out through these sites, they will place an “opt-out” cookie on your device indicating that you do not want to receive interest-based advertisements.  Opt-out cookies only work on the internet browser and device they are downloaded onto.  If an individual wants to opt-out of interest-based advertisements across all browsers and devices, they will need to opt-out on each browser on each device they actively use.  If an individual deletes cookies on their device generally, they will need to opt-out again.

If an individual wants to “opt out” of receiving online interest-based advertisements on mobile apps, they should follow the instructions at http://www.aboutads.info/appchoices.

Please note that when an individual “opts-out” of receiving interest-based advertisements, this does not mean they will no longer see advertisements from us.  It means that the online ads that an individual does see from DAA program participants should not be based on their interests.  We are not responsible for the effectiveness of, or compliance with, any third-parties’ opt-out options or programs or the accuracy of their statements regarding their programs.  In addition, third parties may still use cookies to collect information about an individual’s use of our Services, including for analytics and fraud prevention as well as any other purpose permitted under the DAA’s Principles.

Your Choices

If you are a resident of the EU, UK, California, or another jurisdiction with an applicable privacy law, you may have certain rights available to you. These rights may include:

The right to access and rectify your data;

The right to erase or delete your data;

The right to data portability;

The right to restrict and object to the processing of your data (including for direct marketing purposes);

The right to opt out of the sale of your information;

The right to opt-out of marketing emails and text messages;

The information that we collect through or in connection with the Services is transferred to and processed in the United States for the purposes described above. Shoplift also may subcontract the processing of your data to, or otherwise share your data with, affiliates or third parties in the United States or countries other than your country of residence. The data-protection laws in these countries may be different from, and less stringent than, those in your country of residence. By using the Services or by providing any personal or other information to us, you expressly consent to such transfer and processing.

Non-Personal Information

Data from Shopify APIs: With your consent, upon installing Shoplift from the Shopify App Store, Shoplift sends and receives certain data to and from your Shopify storefront using the Shopify GraphQL Admin API and Webhooks, specifically the Theme Object, Assets Object, Products Object and Orders Object, allowing Shoplift to provide core features, such as A/B testing, conversion optimization analysis, app blocks, and custom sections. Shoplift is unable to be used without access to the Shopify Admin API objects listed herein. The data collected from Shopify’s APIs does not under any circumstance include personally identifiable information related to any user: specifically, a user’s first name, last name, email address, phone number, or street address.

Children

This Site and the Services are solely intended for and directed at individuals over the age of 18. We do not knowingly collect personally identifiable information from visitors under the age of 18.

What This Policy Does Not Cover

This Privacy Policy applies only to the Services.  The Services may contain links to other web sites not operated or controlled by Shoplift (the “Third Party Sites”).  The policies and procedures we described here do not apply to the Third Party Sites.  The links from the Services do not imply that Shoplift endorses or has reviewed the Third Party Sites.  We suggest contacting those sites directly for information on their privacy policies.

Changes to Shoplift’s Privacy Policy

Shoplift may make changes to the Services in the future and as a consequence will need to revise this Policy to reflect those changes. Shoplift will post all such changes on the Site, so you should review this page periodically. If we make a material change to the Policy, you will be provided with appropriate notice.

Data Security

Shoplift takes reasonable steps to protect your personal information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction, taking into account the risks involved in the processing and the nature of the personal data. However, no application, Internet, or email transmission is ever fully secure or error-free, and we do not guarantee the security of any personal information. You are also responsible for ensuring that your account and the passwords we provide you are protected.
